A New York federal judge on Friday tossed an ex-Clifford Chance LLP partner's putative class action over fees charged to the firm's 401(k) plan, saying Merrill Lynch didn't have discretionary control over the plan and therefore wasn't acting as a fiduciary under the Employee Retirement Income Security Act.
