Biotronik Wants Insurers' $28M Pacemaker Verdict Suit Axed
Biotronik Inc. urged an Oregon federal judge Tuesday to nix a suit by two insurers alleging they don't have to cover underlying actions accusing Biotronik and a New Mexico doctor of implanting unnecessary pacemakers, one of which resulted in a $28 million judgment, saying the suit is duplicative of its own previously-filed complaint.

Two insurers told an Oregon federal judge Thursday that they owe no coverage or duty to defend to Biotronik Inc. in two underlying suits accusing the company and a New Mexico doctor of implanting unnecessary pacemakers, one of which resulted in a $28 million judgment.
