A proposed Telephone Consumer Protection Act class action against Hooters based on a single text message sent by the restaurant chain will settle for about $1.3 million in gift cards distributed to recipients of the text, according to a motion filed in Georgia federal court.

A Georgia federal judge declined to toss litigation against Hooters over allegedly unsolicited text messages or strike the proposed class claims, holding Wednesday that sending a single message that violates the Telephone Consumer Protection Act is enough to give the recipient standing.

The man accusing Hooters of sending him an unsolicited text message in violation of the Telephone Consumer Protection Act alleges no actual harm, which, in the wake of the U.S. Supreme Court's Spokeo ruling, is cause for his proposed class action's dismissal, the restaurant told a Georgia judge Thursday.
