The Sixth Circuit on Wednesday said in a split decision it wouldn't reconsider its decision reviving a proposed class action against Nationwide Mutual Insurance Co. over a 2012 data breach that leaked millions of Social Security numbers.

Nationwide Breach Ruling Misread Clapper, 6th Circ. Told
A pair of Nationwide Mutual Insurance Co. customers urged the Sixth Circuit on Friday to revive their putative class action data breach claims, arguing that the lower court had misread the U.S. Supreme Court's Clapper decision and that the threat of identity theft was sufficient to maintain standing.
