A proposed class action accusing Nestle of duping customers into thinking its Coffee-mate creamers were free of allegedly dangerous trans fats has ended in dismissal, after a California federal judge found Tuesday that the claims were preempted by U.S. Food and Drug Administration regulations.

The California federal judge overseeing a proposed class action accusing Nestle USA Inc. of duping consumers into thinking its Coffee-mate creamers don't contain trans fats said Friday she's likely to find that the issue belongs in the U.S. Food and Drug Administration's hands.

General Mills Inc. took aim Monday at a proposed class action in California federal court over partially hydrogenated oils containing trans fats in its baking mixes, claiming that the plaintiff never suffered any harm and that the U.S. Food and Drug Administration has not yet banned the ingredients.
