A New Jersey federal judge declined to wade into a wage spat between the U.S. Department of Labor and a prison company that contracts with U.S. Immigration and Customs Enforcement, saying Friday a DOL administrative law judge should hear the case instead.

The operator of a U.S. Immigration and Customs Enforcement detention facility in Elizabeth, New Jersey, has lodged a suit against the U.S. Department of Labor alleging it is unlawfully allowing a hearing to determine whether the collectively bargained wage rate for contracted employees should be increased.
