BNSF Railway Company failed to upend a nearly $3.7 million negligence verdict by a North Dakota federal jury following the deaths of two of its employees when the Eighth Circuit on Wednesday affirmed contested evidentiary rulings and the denial of a directed verdict by the lower court.
