A man who was among hundreds sickened by salmonella-tainted Peanut Corp. of America products said in Georgia federal court Thursday his proposed class action against an auditor that allegedly failed to prevent the outbreak shouldn't be dismissed because it's not covered by PCA's $12 million settlement.

A food safety auditor accused in a proposed class action of failing to prevent a deadly salmonella outbreak by botching inspections of Peanut Corp. of America facilities claimed in Georgia federal court on Monday that its accuser missed his chance for a payout by not taking part in PCA's $12 million settlement.
