Consumers in a proposed class action accusing numerous electronic cigarette makers of failing to warn them about the supposed dangers of their products asked a California federal judge Monday to reconsider a dismissal based on preemption they contend was “logically inconsistent” and led to “confusing and erroneous results.”

A California federal judge on Tuesday snuffed out most of a consolidated proposed class action accusing numerous electronic cigarette makers of failing to warn consumers of the dangers of their products, finding all but one of the state law claims preempted by recent U.S. Food and Drug Administration guidance.
