Chang's China Bistro Inc. asked a federal judge not to award around $246,000 in attorney fees to its insurance company after the court decided that the restaurant chain wasn't covered under a cyberinsurance policy for nearly $2 million of assessments charged to its card processing agent following a large-scale data breach.

A federal judge has granted a motion for summary judgment against P.F. Chang's in its suit against its insurer, Chubb unit Federal Insurance Co., over assessments that MasterCard charged P.F. Chang's card processing agent following a large data breach, saying the insurance policy unequivocally excludes coverage for such charges.
