Backpage.com CEO Carl Ferrer told Davis Wright Tremaine LLP that it must return the remainder of its $6.25 million retainer if the firm wants to quit representing the sex-ad site in litigation amid criminal charges against the site's leadership, according to a letter made public Monday.

An Illinois county sheriff facing a First Amendment suit filed by Backpage.com asked a federal judge to slap the classified ad site and its counsel with sanctions Thursday, saying the CEO's admission that the site enabled prostitution means its whole suit was based on lies.

An Illinois federal judge indicated Wednesday he would follow a Seventh Circuit ruling that Cook County Sheriff Tom Dart interfered with protected speech on Backpage.com when he asked credit card companies to stop doing business with the classified ad site, but said there was a legitimate question about whether the letters constituted threats.
