A Washington, D.C., federal judge on Thursday denied the Oglala Sioux Tribe of South Dakota's bid to temporarily restrain the Indian Health Service from taking $1.6 million in funds to help satisfy an overtime settlement with IHS workers, saying the tribe hadn't adequately shown permanent harm.

The Oglala Sioux Tribe of South Dakota sued the Indian Health Service Wednesday over $1.6 million in funds it says the service is using to make overtime payments in a settlement with union members instead of making improvements to its health care facilities.
