Blue Bell Creameries Inc. told a Louisiana federal court Friday that a proposed class action lodged after a deadly listeria outbreak should be dismissed because the company paid the plaintiff $450 as a refund for his recalled ice cream and court costs and he hasn't returned the money.

Blue Bell Listeria Case Stayed Pending High Court Ruling
A Louisiana federal judge on Wednesday stayed a putative class action brought on behalf of consumers who'd purchased Blue Bell ice cream that was recalled after a listeria outbreak, after the parties said they want to wait to litigate until the U.S. Supreme Court issues a related ruling.
