An electronic cigarette manufacturer filed a lawsuit Monday against Philip Morris USA Inc., seeking a declaration that the diamond-shaped openings on its electronic cigarettes don't infringe the trademarked "roof design" on the packaging of Philip Morris' popular Marlboro cigarettes.
