Fresh Del Monte Produce Inc. admits its failed trademark lawsuit against a former corporate parent presented a "novel" legal theory, but that's no reason it should have to pay Del Monte Foods Inc.'s legal fees, the company said Thursday in New York federal court.

A New York federal judge issued an opinion Monday that a U.S. lawsuit could not be used to invalidate foreign trademarks, saying such a ruling would be "grossly intrusive" on other jurisdictions.
