Uber and Evanston Insurance Co. have reached a deal in principle in litigation claiming the insurer isn't responsible for covering a settlement over a fatal collision, which spawned counterclaims challenging the insurer's refusal to cover that matter and another accident-related action, according to a Thursday filing in California federal court.

A California federal judge on Monday denied Evanston Insurance Co.'s attempt to shed breach of contract counterclaims by Uber after refusing to defend the technology giant in two suits stemming from car accidents, saying the insurer misinterprets the structure of its excess insurance coverage.

Evanston Insurance Co. sued Uber Technologies Inc. on Tuesday seeking a declaratory judgment that it isn't required to cover Uber's settlement with the family of a 6-year-old girl killed in a collision with an alleged Uber driver, saying its excess policy covers technology, not taxi operations.
