An Arizona federal judge on Thursday shot down Marvel Entertainment LLC's request for attorneys' fees after it prevailed against an inventor's high court appeal in a breach of contract suit seeking royalty payments for an expired Spider-Man toy patent, saying Marvel couldn't relitigate the issue.

Marvel Entertainment LLC asked an Arizona federal court Friday for attorneys' fees following its U.S. Supreme Court victory in a dispute over a Spider-Man toy patent, saying an earlier settlement requires an investor to pay up after the high court upheld a 50-year-old rule barring royalty agreements that continue after a patent expires.
