An Oregon federal magistrate judge declined Wednesday to rethink his determination that the insurer of an asbestos-removal company whose employee was injured during a Del Monte warehouse project has to defend the food manufacturer in the resulting litigation, saying he appropriately considered the effect of an appellate court ruling.

The insurer of an asbestos removal company whose employee sued Del Monte after falling through its roof during a repair project is on the hook to defend the food manufacturer in the underlying litigation, an Oregon federal magistrate judge decided Friday, though he deferred on whether the insurer owes repayment.
