A Korean ship owner facing a wrongful death suit brought by the widow of a fishing boat engineer who was killed on the job has told the Ninth Circuit that even though it did not sign the engineer's employment contract, the dispute still belongs in arbitration.

The Ninth Circuit on Monday directed the widow of a fishing boat engineer who was killed on the job and a Korean ship owner to address the question of whether the owner, a non-signatory to the engineer's employment contract, can arbitrate the widow's wrongful death suit.
