    The Second Circuit said Tuesday it won't rethink a panel decision from December that found U.S. stock exchanges don't enjoy absolute immunity from lawsuits, rejecting the exchanges' attempt to scrap a consolidated group of class actions alleging they misled investors about dealings with high-frequency trading firms.

    A group of investors and seven national securities exchanges that dispute whether the exchanges enjoy absolute immunity from lawsuits told the Second Circuit on Monday that the U.S. Securities and Exchange Commission's amicus brief supports their conflicting arguments, as the investors attempt to revive their "Flash Boys"-inspired suits that were thrown out of district court.

    No Absolute Immunity For Exchanges, SEC Tells 2nd Circ.

    The U.S. Securities and Exchange Commission told the Second Circuit that national securities exchanges do not enjoy absolute immunity and that the self-regulatory organizations are subject to the jurisdiction of district courts, according to an amicus brief filed Monday in an appeal by several groups of investors to revive their "Flash Boys"-inspired suits.
