A Houston hospital facing a wrongful termination suit under the False Claims Act said Thursday the law isn't applicable to the former employee because she never made a complaint alleging the hospital defrauded the government.

A former employee hit a Houston hospital with a False Claims Act retaliation lawsuit Monday, saying the hospital fired her for questioning whether a respiratory clinic was overbilling Medicare and Medicaid by providing patients with medical equipment without an accompanying prescription.
