Workout supplement company USPLabs LLC urged a Texas federal court Tuesday to dismiss an excess insurer's lawsuits seeking to disclaim coverage for underlying claims that USP's supplements have caused serious injury or death, saying there is no actual controversy yet because its primary insurance hasn't been depleted.

Excess insurer Gemini Insurance Co. sued workout supplement company USPLabs LLC in Texas federal court Tuesday, asserting that it has no duty to defend or indemnify the company in underlying suits alleging that USP products containing an amphetamine-like substance caused serious injury or death.
