Excess insurer Gemini Insurance Co. sued workout supplement company USPLabs LLC in Texas federal court Tuesday, asserting that it has no duty to defend or indemnify the company in underlying suits alleging that USP products containing an amphetamine-like substance caused serious injury or death.
