The Ninth Circuit partly revived a suit by a California tribe and a developer over their failed proposal for a casino in a Bay Area city on Friday, saying a district court shouldn't have tossed allegations that the city acted in bad faith by secretly lobbying against the project.

Calif. Tribe Says It Doesn't Owe Fees In Soured Casino Deal
A California tribe again urged the Ninth Circuit on Tuesday to overturn a federal judge's award of $1.9 million in attorneys' fees for Morrison & Foerster LLP lawyers who defended a Bay Area city in litigation over a canceled casino project, saying that an agreement between the tribe and the city didn't include language that would waive the tribe's immunity to such an award.
