The full Federal Circuit on Friday declined to rehear a decision tossing a $2 million patent infringement verdict for NobelBiz Inc., although three judges filed a strong dissent saying the court should address "growing confusion" about when judges must construe patent claims.

A split Federal Circuit panel on Wednesday tossed out a Texas jury's verdict that two NobelBiz Inc. rivals infringed the customer service telecommunications provider's patents, ruling that the district court judge erred by not determining the scope of the asserted patent claims.
