Travelers Insurance and a Texas homebuilding company are heading into mediation to resolve their dispute over whether a Travelers policy allows the insurer to select the counsel used to defend against a defect suit, according to a Monday order in California federal court.

Travelers Insurance told a California federal court Wednesday that, as an additional insured under its policy, a Texas homebuilding company does not have the right to assert its own independent counsel to fight an underlying condominium defect suit and that otherwise, Travelers' duty to defend ends.
