A New York lawyer who admitted in October to helping the perpetrators of the $26 million PermaPave Industries LLC Ponzi scheme told the Second Circuit on Thursday that he had a contractual right to resolve his criminal case before being hit with $2 million in financial sanctions in a parallel U.S. Securities and Exchange Commission case.
