A New Jersey federal judge agreed Tuesday to set aside an entry of default in a suit against Rubin & Rothman LLP over its allegedly illegal debt collection practices on behalf of Toyota's auto lending arm, but denied the law firm's attempt to have the suit dismissed.

A New Jersey man hit debt collection law firm Rubin & Rothman LLP with a proposed class action in New Jersey federal court Monday, alleging the firm violated the Fair Debt Collection Practices Act by misleading him into believing it was aggressively pursuing a debt collection for which he owed additional fees.
