Supplement maker NBTY Inc. asked an Illinois federal court to toss several counts from a proposed class action alleging it overstated the amount of protein in one of its products, saying the Supreme Court's recent Bristol Myers Squibb decision means out-of-state consumers must be pared from the suit.

An Illinois federal judge trimmed a proposed class action accusing supplement maker NBTY Inc. and three subsidiaries of overstating the amount of protein in several whey protein products, concluding Monday that consumers can't bring claims for items they didn't buy, nor can they maintain several other allegations.
