Smoker's Death Shouldn't Pause Arguments, 11th Circ. Told
The attorney for a now-deceased ex-smoker who was fighting for the reinstatement of $20 million in punitive damages against Philip Morris USA Inc. told the Eleventh Circuit Monday that her death is no reason to postpone the oral arguments set for Wednesday, dryly noting that the tobacco company's "compassionate response is touching."

Philip Morris Wants Redo Over Atty's 'Predatory' Comparison
Philip Morris USA Inc. asked the Eleventh Circuit Wednesday to order a new trial in an Engle progeny case that resulted in more than $20 million in damages, arguing that plaintiff's counsel made improper closing arguments that compared the tobacco company to a "predatory stranger stalking children."
