Energy Future Holdings Corp. has urged the Third Circuit to rethink its ruling allowing some $900 million in secured noteholder make-whole claims against the bankrupt energy company, saying New York's highest court should decide the issue.

Energy Future Intermediate Holding Co. LLC shorted first-lien noteholders by about $431 million when it refused to hand them a make-whole amount while paying off $4 billion in notes accelerated by the company's Chapter 11 filing, the Third Circuit ruled in a precedential opinion Thursday.

Bankrupt Energy Future Holdings told the Third Circuit on Wednesday that company creditors are writing a "prescription for disaster" with demands for a $431 million prepayment surcharge based on the company's payoff of a debt automatically accelerated by its Chapter 11 filing in 2014.
