9th Circ. Declines To Defrost 'Ice Age' TM Row With Fox
An artist who lost a suit in New York alleging Fox's "Ice Age" rodent Scrat infringed the trademark for her own creation "Sqrat" has lost again at the Ninth Circuit, where an appellate panel said Wednesday it would not revive her subsequent California suit because the claims are too similar to the previously decided case.

An artist who lost a New York suit alleging Fox Entertainment Group infringed the trademark for her rodent character in its "Ice Age" movies urged the Ninth Circuit on Thursday to revive her subsequent California suit, saying the second suit raises a trademark first-use issue not litigated in New York.
