BNSF Applicant Asks 9th Circ. To Revisit Disability Bias Claim
A BNSF Railway job applicant who recently saw the Ninth Circuit revive his obesity bias claim asked the appeals court to take another look, saying the decision not to resurrect allegations that he was discriminated against for perceived knee and back issues conflicted with circuit precedent.

The Ninth Circuit on Thursday reopened a BNSF Railway job applicant's disability bias suit alleging the company illegally yanked a job offer because of his weight, saying there is enough evidence for a jury to find BNSF's perception that he was obese played a significant role in its decision.

Obesity Is An Impairment, Wash. High Court Tells 9th Circ.
An employer that refuses to hire someone who is obese is violating a state anti-discrimination law, the Washington Supreme Court said Thursday in response to a Ninth Circuit certified question concerning a BNSF Railway job applicant's discrimination suit, saying obesity is a physiological disease that qualifies as an impairment.
