Former Fox News commentator Tobin Smith was held in contempt of court by a D.C. federal judge on Tuesday for promoting a penny stock after agreeing not to do so and failing to pay a $183,000 judgment, exposing him to the risk of arrest.

A former Fox News contributor who failed to show up for or defend himself against U.S. Securities and Exchange Commission allegations, is facing contempt of court and potential imprisonment after a D.C. federal judge found Thursday there's sufficient evidence he's flouted a deal prohibiting stock promotion and requiring a quarter-million-dollar payout.
