A German manufacturer of cold therapy chambers and its U.S. distributor were ordered on Wednesday to prepare for a trial on whether they had a valid agreement to arbitrate, with the distributor saying its contract with the manufacturer was a nonbinding draft.

A German manufacturer of therapeutic cooling chambers asked a California federal court Thursday to send a dispute with a U.S. buyer to arbitration, calling the buyer's suit a "tactical gimmick" from an intellectual property pirate who happens to be €4 million ($4.6 million) behind on its sales commitments.
