Spokeo Invoked In Burlington Terms-Of-Use Suit
The Burlington Coat Factory can't escape a proposed class action brought by a group of online consumers alleging that its "terms of use" impose illegal conditions on customers who visit or purchase products from the retailer's website because the high court's Spokeo decision says it's possible to sue over an an informational injury, a New Jersey federal judge heard on Monday.

Burlington Coat Factory was hit with a class action lawsuit in New Jersey federal court Wednesday alleging that its "Terms of Use" wrongly attempt to absolve the company of its responsibility to avoid creating an unreasonable risk of harm to online customers.
