Marriott Beats Calif. Hotel Worker's Minimum Wage Action
Marriott successfully got a California magistrate judge to toss a former employee's putative class action alleging failure to pay the San Jose, California, minimum wage when the judge said Wednesday the Labor Management Relations Act preempts the worker's claims, requiring the worker to first exhaust the grievance procedure.

Calif. Marriott Hotel Wants Minimum Wage Suit Tossed
A Marriott hotel in San Jose, California, asked a federal judge Wednesday to toss a former employee's class action claims, alleging that the collective bargaining agreement he claimed violated the city's minimum wage ordinance was expressly permitted by that very ordinance.
