A Manhattan federal judge said Friday he is inclined to cut a claim of unjust enrichment from Impax Laboratories' $30 million breach of contract case against Turing Pharmaceuticals, whose ex-leader Martin Shkreli jacked up the price of AIDS drug Daraprim, as the companies tangle over higher Medicaid costs tied to the infamous price hike.

A Manhattan federal judge declined Wednesday to block Turing Pharmaceuticals AG from selling AIDS drug Daraprim featuring the label of Impax Laboratories Inc. per a distribution contract but said Turing, whose ex-leader Martin Shkreli famously jacked up price of the drug, owes for higher Medicaid reimbursement costs tied to the price hike.

Impax Laboratories Inc. in New York federal court on Monday sued Turing Pharmaceuticals AG, the drugmaker previously led by Martin Shkreli, for $20 million, saying that it flouted contractual terms after buying the rights to anti-parasite drug Daraprim and jacking up the product's price by 5,000 percent.
