A Texas federal judge on Thursday rejected a request from the Texas Alcoholic Beverage Commission to dismiss a lawsuit brought against it by the Texas Association of Business that alleges the state agency arbitrarily enforces its own standards governing the sale, manufacturing and distribution of alcohol.

The state of Texas on Friday told a federal judge to dismiss a suit brought against it by the Texas Association of Business claiming that the Texas Alcoholic Beverage Commission selectively enforces its own standards regarding liquor sales licensing because the claims aren't factual and are also barred by the Eleventh Amendment.

The Texas Association of Business filed suit in federal court on Monday claiming the Texas Alcoholic Beverage Commission is in violation of its own standards governing the sale, manufacturing and distribution of alcohol, and has been selectively enforcing the rules for years.
