St. Paul Fire and Marine Insurance Co. and Usenet service provider Giganews Inc. told the Fifth Circuit on Thursday they had settled a battle over coverage of defense costs from copyright litigation.

St. Paul Fire and Marine Insurance Co. urged the Fifth Circuit on Friday to affirm a Texas federal court's ruling that it doesn't have to defend Giganews Inc. in copyright litigation brought by adult entertainment company Perfect 10 Inc., saying the lower court properly held that the underlying suit didn't allege a covered advertising injury.

Giganews Inc. told the Fifth Circuit on Thursday that a lower court erred by holding that St. Paul Fire and Marine Insurance Co. didn't have to defend it in adult entertainment company Perfect 10 Inc.'s copyright litigation, saying the determination was wrong under the policy and Texas law.
