Express Scripts Dodges Suit Claiming It Stole Clients
Express Scripts on Tuesday escaped a suit from six independent pharmacies accusing it of using patient data gained through its pharmacy benefit management business to steal clients, with a Missouri federal judge ruling a contract between the parties required the pharmacies to attempt mediation before filing a suit.

Express Scripts Inc. has asked a Missouri federal judge to permanently end a lawsuit brought by six independent pharmacies, saying that contracts between the two sides prove that it owns the patient prescription information it allegedly used to steal the pharmacies’ customers.

Express Scripts Stole Customers, Retail Pharmacies Say
Express Scripts Inc. has been using patient prescription data gained as part of its pharmacy benefit management business to secretly steal clients from the independent pharmacies it contracts with and boost its mail-order business, five pharmacies said in a putative class action filed Monday in Missouri federal court.
