A California federal judge on Thursday tossed a 7-year-old investor suit against prenatal diagnostic company Sequenom Inc., saying the investors show no facts that the board misled investors by approving LabCorp's $371 million takeover at $2.40 per share, but ruled the plaintiffs can amend the suit and try again.

A California federal judge has appointed Robbins Geller Rudman & Dowd LLP as lead counsel in an investor suit against prenatal diagnostic company Sequenom Inc., saying on Tuesday that none of the other investors have challenged the presumptive lead plaintiff status of the law firm's client.
