8th Circ. Sets Standing Marker With Data Breach Rulings

The Eighth Circuit recently added to the increasingly fractured standing landscape that has emerged post-Spokeo by issuing a pair of decisions in putative data breach class actions that attorneys say demonstrate the court's skepticism toward harm that has yet to materialize and the challenges that plaintiffs are likely to face if they get past standing.

8th Circ. Axes Scottrade Breach Row, Despite Standing

The Eighth Circuit on Monday refused to revive a putative class action over a 2013 data breach at Scottrade, ruling that while the plaintiff had established standing by alleging that he had paid for data security protections he never received, he failed to adequately allege that the brokerage firm had breached its contractual obligations.

Hack Victims Want 8th Circ. To Revive Scottrade Breach Suit

A putative class of Scottrade Inc. users asked the Eighth Circuit on Monday to revive their suit against the discount brokerage for allegedly faulty cybersecurity measures, saying they have the standing to sue because they had to pay to monitor their credit after Scottrade suffered a massive hack and because even intangible harm can be concrete.
