The Seventh Circuit on Wednesday upheld a district court's denial of class certification to a group of home health care workers challenging union fees charged to nonmembers, saying there was no evidence of a common class injury.

Although the U.S. Supreme Court has ruled a proposed class of nonunion Illinois home health care aides were improperly charged union fees, at least one Seventh Circuit judge indicated Wednesday she didn't believe the workers could sue over the fees as a group.

An Illinois federal court illogically denied class certification to a proposed class of home health care workers challenging $32 million in union fees charged to nonmembers, the workers told the Seventh Circuit on Monday, saying the possibility that some workers didn't oppose the taking isn't grounds for certification denial.
