Elon Musk's solar power company SolarCity Corp. can't escape a competitor’s unfair and unlawful competition suit alleging it stole trade secrets after breaking a promise to partner because it’s plausible Cogenra Solar Inc. relied on that promise when it turned down offers from other interested parties, a California federal judge said on Wednesday.

Cogenra Solar Inc. asked a California federal judge Friday not to toss claims in its suit against Elon Musk's solar power company SolarCity Corp. for allegedly stealing trade secrets, arguing that Cogenra has adequately alleged claims for unfair competition and promissory estoppel.

Elon Musk's solar power company SolarCity Corp. urged a California federal judge on Monday to deny rival Cogenra Solar Inc.'s request to seal its complaint against SolarCity for stealing trade secrets, saying that the complaint describes publicly available information and sealing it would “obscure the contours of their alleged trade secrets.”
