The Federal Circuit on Thursday agreed to hear Xitronix's antitrust suit alleging patent fraud against KLA-Tencor after shunting the case to the Fifth Circuit, concluding that because the decision could impact the patent's enforceability, jurisdiction over the case was "not implausible" as it had earlier ruled.
