A Pennsylvania-based activist group opposed to an additional airline operating at a New Jersey airport has withdrawn its environmental lawsuit against the Federal Aviation Administration and plans to refile it with the Third Circuit to follow protocol for challenging government agency decisions.

A Pennsylvania-based community group launched a lawsuit against the Federal Aviation Administration in federal court on Wednesday, accusing the agency of flouting environmental law by failing to consider the impact of allowing Allegiant Air LLC to join Frontier Airlines Inc. in operating at an airport in Mercer County, New Jersey.
