A Florida federal court improperly decided that DePuy Orthopaedics Inc. could enforce a noncompete agreement against a former executive moving to Baxter Healthcare without an evidentiary hearing to determine if she knew any applicable confidential information, the Eleventh Circuit ruled Wednesday.
