A patent-holding company founded by former WilmerHale and Kirkland & Ellis LLP partners has asked a Delaware federal court to keep alive its infringement claims against Netflix, Starz and others, saying the streaming sites "oversimplify" claims of the data storage patent at issue in arguing that it is invalid.

Streaming sites including Netflix Inc. and Starz Entertainment LLC asked a Delaware federal court on Monday to toss data storage patent-infringement claims lodged by an IP litigation company founded by former WilmerHale and Kirkland & Ellis LLP partners, saying the company’s patent is invalid under the Alice standard.

Blackbird Technologies, a patent litigation company founded by former WilmerHale and Kirkland & Ellis partners, sued Netflix Inc. and Starz Entertainment LLC Wednesday in Delaware federal court for infringement of a patent relating to retrieval of pre-stored digital data for offline viewing.
