A Florida federal judge on Wednesday dismissed Sunscreen Mist Holdings LLC's suit accusing a rival of infringing its patent for an automatic sunscreen application vending machine and of falsely claiming it was the first of its kind, because it failed to serve the defendant in time.

Sunscreen Mist Holdings LLC filed a suit in Florida federal court Friday accusing a rival of infringing its patent for an automatic sunscreen application vending machine and telling customers that its competing device is the first of its kind to secure clients like a Hyatt Regency hotel in Florida.
