A potential class of heart surgery patients can't prove that they suffered an injury just because Intuitive Surgical Inc.'s da Vinci surgical robot left metal fragments in their brains, the Eleventh Circuit said Monday in shooting down the patients' appeal.

A proposed class of heart surgery patients urged the Eleventh Circuit on Friday to revive their suit against Intuitive Surgical Inc., arguing the Georgia district court was wrong to decide having metal lodged in their brains from the company's surgical robot doesn't constitute an injury.
